My rear shock bolt (the one that holds the shock to the frame.) actually fell completly out!!! the bike only has 2000 miles on it. I called the dealership and bitched them out but he is saying that, the safety inspection on the used bike was done and thats your mistake for not going over every bolt and checking it. I would actually do a walk around before i got on my bike for the night but i never would have thought i should check that.
PS: the bike will not corner with no rear suspension.... HA
As long as you didnt get hurt or dropped the bike i guess no harm done. If you have the bolt and the nut just put it back in and torque it to 20 lbs and your good. I would do a thorough walk around the whole bike to check for other loose nuts and bolts.
i did lay the bike down. front end damage done. broke 2 fingers and was concussed (sp?) for a day. i got hard on the brakes entering a corner (i noticed something wasn;t right) and i guess took the load of the bolt allowing it to come out. and i had no choice but to try and make it through the corner.

Well, if they should or shouldn't have found that during a safety inspection could be determined by your State's specific list of safety inspection requirements. A State Safety Inspection (I'm referring to your yearly State required inspection) doesn't require you to go over EVERY nut and bolt.
As a dealer selling a used bike, you'd think they'd check things out a little closer before taking that liability....
YOU on the other hand, ALSO have a responsibility as a rider, to inspect your bike every time you get on it, including the checking of tire air pressure and the safety of your equipment.

I've had the bike for a month and a half and have riden about 2000miles since i bought it. I did check my tire pressure everytime and did a walk around, but i never thought to go through the bike and check the Tq on all the bolts.
Thanks for the offer on the bolt i did order a new one. as well as most of the other parts i need to repair the bike

in the results of laying the bike down it snapped the front forks off and cracked my front rim, bent rotors, upper fairing cracked, crack one side fairing, exhaust is all scratched and dent both sides, tail fairing rashed. upper fairing stay bent to shit. I was contemplating calling an attorney. whats everyones thoughts on this? research whats involved in the states requirments on safety inspections first?
I can only guess what actually happened but the only reason I could come up with is that the previous owner removed his aftermarket shock and didn't tighten the bolt when he put it back on. I would seek damages from the previous owner and the shop that sold it.
How can you prove the bolt issue is as result of the shops negligence and isn't fraud on the behalf of the Plaintif? Aren't used vehicle sold as is in most cases (30 days max)? Isn't the operator is responcible for the mechanical safety of the vehicle and is advised to thoughly inspect the vehicle prior to operation. Most of us never check air pressure before each ride. For that matter how many people actually retorque lug nuts on thier cars the first 100 miles after rotation or tire changes?
Basically I don't think you have much chance at any suite. Whats sad is you could be 100% correct and the bike was not given a proper going over before resale.

I would check every bolt on the bike if I was buying a used bike. I don't trust any dealer.
