Default Damage during shipment

I bought a RC 51 recently and had it shipped out to me. There was some damage on the bike that I didn't catch at first and the previous owner says it was not there when shipped. I went through the whole process of claiming the damage and the insurance agency denied it. Anyone know if there are any other steps I could take with the insurance agency?

If you didn't report the damage to the shipper at the time you received the bike (i.e. point out the damage to the truck driver) you are unfortunately S.O.L. - that's why it's so important to thoroughly check everything when having a bike delivered to you, because you have to sign for it stating there is/is not any visible damage on it then and there in front of a witness (the driver).

was it your shipper or the seller's shipper? you should be able to file a claim against the shipping agency but not your insurance policy holder if i get what you're saying. hopefully you paid for additional shipping insurance. otherwise, you're SOL like what Suburbanrancher says.

These columns aren't from a MC forum but they explain the laws pretty well in layman terms. To top that off, most freight companies have very draconian rules regarding reporting hidden damage. You haven't said if the shipment was insured etc, and what in particular the damage was, or how you are sure it was caused in transit.

Bottom line is unless you work at position of influence, or own a business that sends a lot of freight by way of that freight Co. you have a very little real world chance of convincing them to pay out.

Depending on how bad or costly the damage was, you could always call a lawyer friend for advice. Mistakes happen but that doesn't mean they can't be corrected. There is always a way.
