Default Should the dealer take back my 05 ST3?

We I just bought a 2005 ST3 after lurking around on this forum. I am disappointed with my purchase however. After I got my brand new bike home I noticed the following:

Broken left rear turn signal.
Damaged left rear luggage bracket.
Windshield has tons of scratches.
Both the clutch and front brake master cylinder resivoirs are over filled and the paint is peeling of the caps.
Right upper fairing as peeling paint.
Small crack in the wet clutch cover.
Oil overfilled.
Dime size dent in the right muffler.
Seat looks used, marks all over the seat cover and extremely dirty underneath.
Own ers manual looks like it fell in a coffe pot and all the pages are stuck together can't read.
Right luggage bag has the swinging door retaining strap missing.

What a mess! Has anyone ever had any experience asking the dealer to just take the bike back and replace it? I can see this turning into a pissing match trying to get these parts replaced, not to mention the leadtimes. I haven' even owned the bike for 24 hours!

I just noticed that the seat doesn't look like an '05 seat either, it looks like an older vinyl type seat. WTF?

Bad news... I would definately take it back and demand a replacement bike or a full refund. Keep us up to date with the happenings, no one likes a dirty dealer.

When I picked it up I was in a hurry to get to work and didn't get a chance to take a good look at it until I got home at which point the dealer was closed. Tomorrow I'm taking the morning off to bring it back and have them look at it. Hopefully there will be something they can do. Iw ould really prefer to get a replacement bike rather then deal with getting everything replaced.

IF it is a new bike as said there should be no questions. Expecially in the relm of replacement parts or fixes. The old "bait and switch". Before you leave with anything you've purchased you should definately do the twice over look.
Demand your money back or an acceptiable replacement bike within a certain time frame.

Was there any miles on the odometer? If you don't get satisfaction. call Ducati North America directly. It was several years ago, but I had a warranty problem resolved by Bob Nevola. Try him at bnevola@ducatiusa.com.

No, there are no miles on the odo. Im know dealers have done the old switch with the instrument panel which resets the miles. Im starting to wonder if this is the case!

Sorry to hear about your experience. I picked my '05 ST3 up this past Sat, and it was a great experience for me. I hope you get some type of satisfaction, but if the dealer states he will not repair/replace anything, I wouldn't be surprised, though I'd feel badly for you.

You took delivery of the vehicle and in doing so implied you were satisfied with the bike after an inspection. I had to sign off on a PDI form that acknowledged the condition of the bike and the receipt of instuctions/manuals/tools etc. If you also did this, and then call back and state you found what to me sounds like *significant* damage etc, they may say, "If it was that bad, then why did you take delivery?" implying the damage may have occurrred after you took delivery.

In any case, stick to your guns. I doubt they'd replace the whole bike, but hey, you never know until you ask/try. At least getting the scratched and dented items replaced would be great, as that type of damage is not covered under warranty afaik. Good luck.

I just picked up an 05 ST3 a week ago, I carefully inspected the bike, only one fairly nut missing, which was added as I waited. I was prompted by the sales person (also a member of the same club I ride with) to give it a good once over. Which I did, nothing I could fine. If I was the dealer I would do whatever it takes to make you happy.
