Default SS1000 Swingarm Dented From Stock Muffler

I just purchased a pair of FBF high ovals from my dealer. When I removed the right side stock can, I noticed a dent and evidence of the stock can hitting the swingarm repeatedly. The right side can has always been very loose as a result of out of tolerance condition causing a loose fit. I did not notice that it was causing damage to the swingarm. I think while riding and hitting bumps, the can hits the swingarm. Do you think my Dealer and Ducati should replace my swingarm? I don't like the cosmetic damage and I am afraid the aluminum may have work hardened in that spot and eventualy start cracking. I also think the O.D. of the header is the problem because the FBF can fits looser than the left side, just like the stock cans.
